FAMILIES OF FALLS COUNTY (TX) ARTICLE, NAMES “Julia Ann Thompson ”

Featherston, born about 1816 in Kentucky,” as mother of Edward Hardiway’s son “Edward John Featherston, and also says Edward John was born in 1836 in Arkansas”. Edward Hardiway lists two sons on the 1850 Scott Co., AR census – Edward Featherston. aged 14 years born in Arkansas and John Featherston Aged 11 years born in Texas. The FAMILIES OF FALLS COUNTY (TX) article appears to have combined these sons names (or was one not a son?) as it says: “Edward John (Jack) Featherston born 1836 in Arkansas, date of death and place of burial unknown, married (1) Catherine Warren who died in Missouri about 1864: married (2) Parmeda (?) in 1864: and with his family came with his father to Falls Co., TX in 1870 settling in an area around present day Chilton. TX.

Anne Reed is not listed here as a wife of Edward Hardiway since Julia D., aged 31 years, born in Kentucky, is alive on his 1860 Granby Township (Newton Co.) MO U.S. Census. His sister Nancy Featherston/Reed/Crow married a Reuben Reed in Scott Co., AR about 1860.

Smyth wrote words and verse printed on their wedding announcement which says, in part: “Our beloved friend Mattie is now a bride …Our best wishes are for the prosperity of our friends as they go hand in hand…..” Francis, a Medical Doctor, was a Civil War 2nd Lieut/Asst Surgeon in 1st Creek AR Regiment which his brother George commanded. Fall of 1991 – Commercial Appeal – Memphis, Tennessee
Civil War author will visit Shiloh

SAVANNAH, Tenn. – A noted British author and historian, and a descendant of Ulysses S. Grant will be among Civil War enthusiasts who will stop here next week as a part of a 10-day tour of battlefields.

Donald Featherstone, author of 20 books, and Margaret Grant, a great-great-great-grandniece of General Grant, will visit Shiloh and the Cherry Mansion in Savannah, which was Grant’s headquarters before the battle of Shiloh.

Featherstone is gathering material for a new book on the Civil War. He and three other historians from England began the tour in Atlanta Tuesday. Featherstone said the tour is not so much for research as to “put my feet on the actual ground where the fighting took place.”

The group is scheduled to arrive in Savannah Sunday night and will visit the Shiloh National Military Park Monday. Featherstone will lead an informal discussion at a gathering of Civil War buffs and descendants Monday night.

This cause coming on to be heard and the same having been heard before his Honor Benjamin F. Long, Judge presiding and holding the courts in and for the 14th Judicial District in and for the State of North Carolina, and it appearing to the court that the summons was duly issued and served upon J.B. Featherston, ten days before the return day of the October Term, 1911, of this court, as is required by law; and it further appearing to the court that service by publication as is required by law of the summons was had upon J.B. Featherston; and it further appearing to the court that the complaint duly verified has been filed in this cause in due time, as it is required by law and it further appearing to the court that McD. Ray, of counsel of the defendant J.B. Featherston. appeared in open court at the October Term 1911 therof, and was granted time within which to file and answer to said complaint by the said J.B. Featherston; and it further appearing to the court that the time heretofore granted has elapsed and that the said J.B. Featherston has failed to find any answer to said complaint, or to give any defense bond, as is required by law that he shall do. and that said J.B. Featherston has not been excused from giving the undertaking required in such cases as is required by law that he shall do: and it further appearing to the court that this is an action for the recovery of real property; and it further appearing to the court that the plaintiff’s complaint states a cause of action against the defendant J.B. Featherston, which entitles him to the relief therein demanded and prayed for; and it further appearing to the court from the record plaintiff A.A. Featherston paid the purchase money for the lands described in the complaint, and that the legal title thereto was made to Mary E. Featherston for the use and benefit of the plaintiff A.A. Featherston and that the said Mary E. Featherston held said lands as trustee for the use and benefit of the plaintiff A.A. Featherston; and it further appearing to the court that the plaintiff A.A. Featherston is the equitable owner of said land and is entitled to have the legal title thereto vested in him, it is therefore considered ordered adjusted and decreed by the court that the plaintiff A.A. Featherston is the owner in fee simple of said land described in the plaintiff’s complaint which lands are described as follows, to wit: – Beginning on a white oak known as the beginning corner of a State grant to David Miller, and running a South West course with Mariah C. Alexander’s line to where said line intersects S.T. Fatherston’s line on the south side of cont.

Case’s line; thence with said branch to the head of a ditch; thence down said ditch thirty poles to a white pine and three Maples; Thence North Twenty teen(?) degrees West to the back line clained by A.M. Featherston, thence with the said line to the Beginning, together with all and singular the right’s. Members hereditaments and appurtenances to the said premises belonging to or in any wise incident or appertaining, and being the same tract of land belonging to William Featherston prior to the 28th day of May, 1870, and sold to Seborn T. Featherston as assignee in Bankruptcy of the said William Featherston on the said 28th day of May, 1870 and a deed thereof made to Mary E. Featherson which deed is registered in the office of the register of Deeds in Henderson County in Book … Page___ and being the same land described in a partition proceeding dividing the lands of A.M. Featherstone deceased by B.H. Merrimon, G.B. Johnson, John Woodfin, John Miller, Jesse Featherston and James Brittain, commissioners, between William Featherstone, S.T. Featherstone and Mariah C. Featherstone, legatees, under the will of A.M. Featherstone, and designated at Lot no.3, which proceedings is recorded in the office of the Register of Deeds of Henderson County, in Book no. 12 at page 217 at seg. To which Partition Proceeding Book and Page and particular Lot no. 3, reference is hereby made for a further description of said land. It is further considered, ordered, adjudged and decreed that the defendant J.B. Featherston, together with N.B. Featherston, S.M.Featherston, Enna Featherston, Littie Featherston, Mamie Featherston, Sallie Featherston, Minnie Featherston and Alice Stepp and her husband Decatur Stepp are the holders of the bare naked legal title to the said land above described. They being the sole survivors of the said Mary E. Featherston, deceased, and as such are holders of the same as trustees for the use and benefit of the plaintiff A.A. Featherston: it is further adjudged and decreed that this decree and judgment shall operate as a conveyance of the legal title to the land above decribed from the defendants N.B. Featherston, S.M. Featherston, Sallie Featherston, Minnie Featherston, Lillie Featherston, Mamie Featherston, Emma Featherston, and Alice Stepp and her husband Decatur Stepp, and this defendant, J.B. Featherston to the plaintiff A.A. Featherston; and it is further ordered by the court that this judgment be recorded in the office of the Register of Deeds for Henderson County, State of North Carolina in the records therein kept for the registration of Deeds: this judgment to stand unless J.B. Featherston had appeared by Clerk and answer for himself within 20 days from this time.

Featherston as assignee in Bankruptcy of the said William Featherston on the 28th day of May 1870, and a deed therefore made to Mary E. Featherston, which deed is registered in the office of the Register of Deeds for Henderson County in Book ___ at page___ and being the same land described in a partition proceedings dividing the lands of A.M. Featherston deceased by B.H. Merrimon, G.B. Johnson, John Woodfin, John Miller, Jesse Featherstone and James Brittain, Commissioners between William Featherston, S.T. Featherston and Mariah S. Featherston legatees under the will of A.M. Featherstone and designate as Lot no. 3, which proceedings is recorded in the office of the Register of Deeds of Henderson County in Book No.12 – at page 217 et seq, to which partition proceedings Book and page and particularly Lot No. 3 reference is hereby made for a further description of said land.

It is further considered ordered, adjudged and decreed that the defendants N.B. Featherston, S.M. Featherston, Emma Featherston, Lillie Featherston, Mamie Featherston, Sallie Featherston, Minnie Featherston and Alice Stepp and her husband Decatur Stepp are the holders of the bare naked legal title to the said lands, they being the sole survivors of the said Mary E.Featherston deceased, and as such are holders of the same as trustees for the use and benefit of the plaintiff A.A. Featherston it is further adjudged and decreed that this decree and judgment shall operate as a conveyance of the legal title to the lands above described from the defendants N.B. Featherston, S.M. Featherston, Sallie Featherston, Minnie Featherston, Lillie Featherston, Mamie Featherston, Emma Featherston and Alice Stepp and her husband Decatur Stepp to the plaintiff A.A. Featherstone; and it is further ordered by the court that this judgment be recorded in the office of the Register of Deeds for Henderson County with records therein kept for registration of Deeds.

Jeremiah Featherston Last Will and Testament

(KFH: Jeremiah, son of Carolus and Lucy (Elmore) Featherston – Branch #1)

In the name of the benevolent Father of all , I Jeremiah Featherston of the County of Marion and State of Indiana do make and publish this my last Will and Testament.

Item1st. I give and devise to my beloved wife Anna Featherston as long as she remains my widow and in lieu of her interest in my lands, one third of the farm on which I now reside situate in the County of Marion, in the State of Indiana it being the west half of the south east quarter of section seventeen (17) in Township Fourteen (14) in Range Four (4) East; containing about Eighty (80) acres, also one third of my three lots in Alion(?) addition to the town of Zionsville in Boone County in the state of Indiana, known and numbered as Lots thirty four (34) Seventy one (71) and seventy two (72), and one third of my five (5) acres it being the south half of the south half of the north half of the north half of the East half of the North west quarter of section twenty four (24) in Township Fifteen (15) in Range three (3) East, it being in the County of Marion in the State of Indiana.

Also a sufficient amount of my stock, household goods and furniture provisions and other goods and chattels which may be thereon at the time of my decease as long as she remains my widow as aforesaid, which amount of stock Household goods Furniture provisions and other goods and chattels shall be determined by my Executors hereinafter appointed.

If my said wife should not survive me then I devise and bequeath the property devised and bequeathed to her as aforesaid to my children as follows to wit.: to my sons John G. Featherston, William E. Featherston, James G. Featherston, Robert J. Featherston, Jeremiah M. Featherston and my daughter Nancy Mariah Bradley to be equally divided between them.

I also give and devise to my children as aforesaid the remainder of my personal property goods and chattels moneys on hand and moneys loaned out not before bequeathed to my wife as aforesaid to be equally divided between each of them as aforesaid after selling so much thereof as may be required to pay all my just debts, paying my funeral and burying expenses, and a sufficient amount to build a good plank fence around the grave yard hereinafter described and Twenty-four dollars which I bequeath to my son Charles G. Featherston and twenty-four dollars to my daughter Lucy Ann Neal and twenty-four dollars to my grandson Jeremiah Samuel Kuser and twenty-four dollars to each of my granddaughters as follows: to Lydia M. Kuser, Anna Kuser and one hundred dollars to Jeremiah Robert Osterbrigg my other grandson.

If my personal property as aforesaid should not be sufficient to pay the amounts as aforesaid then I desire that the Real Estate as aforesaid less one half acre should be sold and out of proceeds of said lands make up the deficiencies of said sums and the remainder of the proceeds thereof to be equally divided between my sons John G. Featherston, William E. Featherston, James G. Featherston, Robert J. Featherston, Jeremiah M. Featherston and my daughter Nancy Mariah Bradley. The half acre above reserved is on the Farm on which I now reside known as the family Grave yard and which I now reserve for the use of my family for that purpose with the right of way to and from the cont.

same it is described as follows to wit: commencing eleven feet due south east of a cherry tree that is on the south side of Burwell Featherstons grave, and running due north to the north line of line of the farm on which I now reside as herein before described thence due west south of said cherry tree as aforesaid thence due east to the place of beginning.

Item 2: I do hereby nominate and appoint William E. Featherston and James F. Featherston my two sons Executors or Administrators of this my last will and Testament hereby authorizing and empowering them to take charge the moneys willed to Jeremiah Samuel Kuser, Lydia M. Kuser, Anna Kuser, Susan Kuser and Jeremiah Robert Osterbrigg until they arrive to the age twenty one and then pay the same over to each one of them as aforesaid, also to compromise, adjust release and discharge in such manner as they may deem proper the debts and claims due me. I also direct that my executors or administrators have the power to sell said personal property without appraisement and public sale as aforesaid.

I do hereby revoke all former wills by me made, in testimony hereof I have hereunto set my hand and seal this nineteen day of October in the year of our Lord one thousand Eight hundred and sixty. 1860.

Todd subscribing witnesses to the foregoing instrument of writing who being by me first duly sworn upon oath depose and say that Jeremiah Featherston the testator named in the instrument of writing purporting to be his last will and testament did sign seal publish and declare the same to be his last will and testament on the day of the date thereof, that the said testator was at the said time of the full age of twenty one years and of sound and disposing mind and memory, and that he was not under coercion compulsion or restraint, and that he was competent to devise his property.
