ANCESTORS AND DESCENDANTS OF JUDGE L.H. FEATHERSTON(1)

Family tradition has always had it that the Featherstons in America were descended from three brothers. Henry, Charles, and Edward, who emigrated to Virginia about 1750. This tradition has no basis in fact. There were Featherstons in Virginia more than a century earlier: Ellen Fetherston, who came as a headright of William Warren in 1642, and William Fetherstone, who came as a headright of Robert Richardson in 1662. William had a son, William, living in Amelia Co., Va. who left a large family(2).
The earliest ancestor in America of Judge Lucius Horace Featherston was

Charles FEATHERSTON (also spelled Fetherstone, Featherstone), b. ca. 1635 in England, emigrated as a headright of Major Abraham Wood to Charles City Co., Va. in 1653(3), and d. ca. 1681. He settled in that part of Henrico County that later became Chesterfield County, and on 19 August 1672 was granted a tract of land of 700 A.
This land is described as being on the north side of the Appomatox River corner to the orphan’s land of Mr William Walthall, near Timbury Run Plantation, now the site of Petersburg(4). In 1679 Charles was named in a list of ’40 tythables’ ordered by the court to ‘fit out arms and men’. He was assigned a quota of three men(5).
In August 1682 his widow, Rebecca, was granted administration of his estate. She later married Samuel Newman(6). The issue of Charles and Rebecca was:

Ann, whose will in Amelia Co., Va. is dated 12 December 1745, m. Abraham Burton, b. ca. 1669 in Henrico Co., Va., whose will in Amelia Co., Va. is dated 13 May 1736. Their descendants are numerous.

Henry, q.v.
Henry Featherston was upwards of 21 when he discharged his guardian, who was his stepfather, on 20 August 1702. Therefore he was b. ca. 1680. Henry is listed on the quit-rent roll of Henrico Co. in April 1705(7). He d. ante 1759. for the will of his widow, Elizabeth, is dated 26 February 1759.

In the name of God Amen February 26th, 1759 I Elizabeth Featherston Wido being weak in Body but of Perfect sound Memory praised be to God for the same but knowing the uncertainty of this Life do make and ordain this my last Will Testament
First, I give my Soul to God who gave it and my body to Earth from whence it was taken to be decently Buryed at the Descretion of my Executor hereafter named and for what worldly goods It Hath pleased God to dispose upon me I do Dispose of in manner following,
Item I give and bequeath to my son Henry Featherston all my stock of Cattle Puter and three Beds with the Furniture belonging to him and his Heirs forever and two Potts and one Kittle. cont..,

Henry Charles (or Charles Henry) or, usually, Charles Featherston can be traced through various land transactions and other documents in Henrico (Chesterfield) Co. during the period 1740-1770, but they tell us little beyond the facts that he was a surveyor and held a good deal of property(10). He m. Phebe Walthall, who was b. ca. 1720(11). She was the daughter of Henry Walthall and Phebe Ligon. The ancestry is shown in the following chart:(12)

Henry Featherston m. Elizabeth Marshall, the daughter of Alexander Marshall, son of Alexander Marshall who m. ca. 1706 Elizabeth Worsham Ligon (widow of Thomas Ligon), and Sarah Moseley, daughter of William Moseley(19) and Frances Mayo. Henry moved to Smith County, Tennessee and d. 15 December 1827. His will was probated 28 July 1828.

WILL OF HENRY FEATHERSTON(20)

I Henry Featherston of the County of Smith and State of Tennessee being of sound mind and memory thanks be to God for all his Mercies, do make this my last will and testament revoking all others hertofore by me made (Viz)
Item 1st I lend my daughter Sarah Hardy during her natural life one acre of land including the house she now lives in with access to what is called Featherston’s Spring, she is to have free all of firewood off of my part of the balance of my land, but she is not to sell, rent, or place any other person, or family on it.
Item 2nd. I lend my daughter Sarah Hardy during her natural life, my negro girl named Harriet.
Item 3. I give to my son Edward Featherston, after the death of my daughter Sarah Hardy, the negro girl Harriet, named in the 2 item of this my will, if he thinks proper to receive her, upon the following conditions (Viz) he must pay to my grand daughter Sarah W. Hardy seventy five dollars. If the said negro girl should have any increase before the death of my daughter Sarah Hardy, the said increase is to belong to my grand daughter Sarah W. Hardy. But if my son Edward Featherston should not take the girl Harriet according to this Item, she is to belong to my grand daughter Sarah W. Hardy and her heirs forever, I also give to my son Edward Featherston my tract of land whereon he now lives to him and his heirs forever, containing one hundred acres more or less, one acre of which is loaned in the first Item of this will to my daughter Sarah Hardy.
Item 4. I lend to my daughter Polly Cogbill during her natural life, my negro girl named Milly, and after the death of my said daughter Polly Cogbill, I give the said negro girl Milly to my grand daughter Elizabeth M. Cogbill and her heirs forever.
Item 5. I give to my grand daughter Elizabeth C. Sharp my negro girl named Mariah with her increase to her and her heirs forever.
Item 6. I give my grand son James H. Sharp and his heirs forever my negro boy named Scipio.
Item 7. I give my grand son Benjamin F. Sharp and his heirs forever my negro boy named Richard or Dick.

My will and desire is that my negro woman named Cate and the child she now has named Martha not mentioned in this will before together with their future increase remain in the hands of my son in law M.D.L.F. Sharp free from hire till my grand daughter Elizabeth C. Sharp becomes of lawful age or marries, at which time they are to be divided between my grand children Elizabeth C. Sharp, James H. Sharpe, and Benjamin F. Sharpe, so as to make them as near equal as possible, taking their losses between this and said division into consideration. My will and desire is that if any one or two of my three grandchildren Elizabeth C. Sharp, James H. Sharp and Benjamin F. Sharp should die before he, she, or they become of lawful age, or marry, that the property given to the deceased be equally divided between the surviving full brother and sister or brothers as the case may be. But if my three grand children named in this Item should all die before they come of lawful age or marry, then the property will led] them is to be equally divided between my son Edward Featherston, my daughter Polly Cogbill and my son in law M.D.L.F. Sharp.
Item 10. I give to my son Edward Featherston all my property not otherwise disposed of in this will. I also will to him as compensation for his trouble with me, and for acting as an executor to this will one note of hand which I hold on him and is enclosed in this will, for one hundred dollars, due 25th, December 1827.
Item 11. I will and bequeath unto my son Charles Featherston, Betsy Cogbill and the heirs of Henry Featherston one dollar each, for the love and respect which I have for them, and lastly I constitute and appoint my son Edward Featherston executor to this my last will and testament. In testimony where of I have herunto set my hand and seal this 15th, day of December eighteen hundred and twenty seven

My Dear Niece
This is to thank you for fine letter from you just received. I have often wondered where you all were. My recollection is that my last letter from Renick was received just after we had gone through the great Galveston Storm, then to letter inviting us to your weding.
I am gratified to learn that you are so blessed with girls, and so fortunate as to be comfortably located on a California farm.
Answering your inquiry as connections of names – My Brother & I were the Grandsons of a Miss Renick who married David Porter. They were married in Tennessee & moved to Mississippi something more than a hundred years ago. Our Father L.H. Featherstone & our mother Zuchaina Porter, were married A.D. 1850 – at Oxford Miss. I was born at Oxford Mississippi July 28, 1851. Renick’s Father was born Oct 8, 1853. Our Parents moved into West Tennessee in 1859. We were raised in Shelby County Tennessee, near Memphis. My Brother & I moved to Arkansas in 1881. He died there in 1883. He was a splendid man in appearance, and lovable in character. He had the respect & confidence of every one who knew him. When last I met Ren he greatly resembled him in many ways. He will recollect when we strolled down Broadway on Fifth Ave. on Sunday afternoons dividing the best buildings between us. It was there in humerous , smiling make believe, that he strongly reminded me of my brother, his father. I often think of him, & will do my best to visit you all this year.
I will immediately write to my son, Pen’s cousin, who is in Los Angeles –

Today happens to be the Birthday of his daughter, my eldest grandchild. She is seventeen today. He has a son, who is about 13 and a younger daughter of about ten. I have a son Paul P. Featherstone who lives at Rusk Texas. He has four children, two girls & two boys. My third son John D. Featherstone, lives at 2719 Broadway, Galveston. He has two sons. I am writing my wife tonight, who is in San Antonio & will mail her your letter. She will be glad to hear from you all & will write you soon. I very much appreciate your writing me & hope to hear from you regularly.
It will afford me great pleasure to hunt you up & see you all as soon as possible, this summer perhaps.

I loved him better than anything and named a girl doll Grandpa for him. Mother told me it wasn’t nice for me to ask him if he had any chewing gum for me, so I climbed up on his lap & put my arms around his neck and said, “You great big old blue-eyed baby” and he emptied his pockets for me. Mother and I were at his bedside when he died about 4 a.m. He was a farmer & County Court Clerk. He had a heart attack the day the mob stormed the Court House in Dec 1934. The mob did allow the records to be removed from his office, which was fortunate, because later that day and/or night the Court House burned. The Natl. Guard was surrounding the Court House that day. The town was under martial law for a good many days after the fire, etc. Grandpa later had a stroke which somewhat affected his ability to speak the word he was thinking of. He always wore a hat (even indoors, except at table during meals), to keep from catching cold. He wouldn’t get a haircut during the month of March. Vanderbilt University School of Medicine), but decided not to continue the practice of medicine. He was supposed to have been one of the 3 men who bred and started the Tennessee Walking Horses. I think his were the Allen strain, because Aunt Marg’s horse was named Al. He gave Mother for ther wedding present a mare named Maude, who was the grand-dam of Lily White, the 1st World Champion TN Walking Horse. Maude stayed out in the country at the farm and never lived in town with us, but we rode her when we went to the farm. She was a strawberry roan and very gentle.
